Terms of Use

Effective October 7, 2026.

These Terms of Use ("Terms") govern access to and use of NotUserError.com and its related software, services and documentation (the "Service"), operated by GateIron, LLC, an Oregon limited liability company ("GateIron," "we," "us" or "our").

1. Acceptance

By creating an organization, signing in, or otherwise accessing or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "Subscriber" means that organization. Each individual who uses the Service (a "User") also agrees to these Terms. If you do not agree, do not use the Service.

"Subscriber Data" means all content submitted to the Service by or for a Subscriber or its Users, including requests, comments, questions, answers, files, settings and account information.

2. Other Agreements

A written agreement signed by GateIron and a Subscriber that expressly refers to and modifies these Terms controls to the extent it conflicts with them. No purchase order, procurement form, click-through or other document supplied by a Subscriber adds to or changes these Terms, even if GateIron accepts, signs or acts on it, unless it says so expressly and is signed by GateIron.

3. The Service

GateIron provides the Service as it exists from time to time. We may add, change, suspend or remove any feature, or discontinue the Service, at any time and for any reason, with or without notice. Features described as beta, preview, test or demonstration are provided for evaluation only and may be changed or withdrawn at any time.

The Service is a tool for recording and tracking requests. It is not an emergency or safety system, a records-retention system, a system of record required by any law, or a backup service.

4. Not for Emergencies

Do not use the Service to report or respond to emergencies, threats to health or safety, or any matter that requires immediate action, including any matter that law requires be reported to an authority. Notifications, including email and chat messages, may be delayed, filtered or not delivered, and marking a request "Urgent" does not ensure any response. Subscriber is solely responsible for maintaining other means of handling such matters.

5. Accounts and Access

Sign-in is provided through third-party identity providers. GateIron is not responsible for their availability, acts or omissions.

Subscriber controls who may access its organization, including permitted domains, invitations, access levels, groups and the visibility of each request. Subscriber is solely responsible for those choices and for all activity in its organization and under its Users' accounts, including activity by anyone admitted by Subscriber's settings. Users must keep their accounts secure and must not share them. Subscriber must promptly tell GateIron of any unauthorized use it becomes aware of.

Access tokens issued for scripts or AI assistants act with the authority of the person who created them. Subscriber is responsible for every action taken with them.

The Service is not directed to children under 13. A Subscriber that permits minors to use the Service is solely responsible for any consent, notice or supervision the law requires.

6. Subscriber Responsibilities

Subscriber is solely responsible for:

Subscriber will not submit, and will direct its Users not to submit, payment card data, government identification numbers, financial account numbers, passwords, or health or medical records. Subscriber accepts sole responsibility for any information about students that it or its Users submit.

7. Acceptable Use

You will not, and Subscriber will ensure that its Users do not:

GateIron decides in its sole discretion whether conduct violates these Terms.

8. Subscriber Data

As between Subscriber and GateIron, Subscriber owns Subscriber Data. Subscriber grants GateIron and its service providers a worldwide, royalty-free, non-exclusive license to host, store, copy, transmit, display, process and otherwise use Subscriber Data to provide, operate, maintain, secure, support and improve the Service, to prevent abuse, and to comply with law and legal process.

GateIron may collect and use information about how the Service is used, and may create and use aggregated or de-identified data derived from Subscriber Data, for any lawful purpose, so long as it does not identify Subscriber or any individual.

GateIron may access Subscriber Data to support and operate the Service, and may disclose it when GateIron believes in good faith that law or legal process requires it, or that disclosure is needed to protect the Service, GateIron, Users or others.

GateIron may remove or disable access to any content it believes violates these Terms or the law, but has no obligation to monitor content.

The Privacy Policy describes how GateIron handles personal information.

9. Security, Data Loss and Export

GateIron takes the measures it considers appropriate to protect and back up the Service, but does not guarantee that Subscriber Data will not be lost, corrupted, disclosed or accessed without authorization. Subscriber is responsible for exporting and keeping copies of any Subscriber Data it needs. A deletion made by Subscriber is permanent and GateIron may be unable to reverse it. After a Subscriber's use of the Service ends, GateIron may retain or delete Subscriber Data as the Privacy Policy describes, and has no other obligation to keep or return it.

10. Third-Party Services and Integrations

The Service relies on, and may connect to, services that GateIron does not control, including hosting, email delivery, identity providers, chat platforms and AI assistants. Subscriber's use of any integration it enables is between Subscriber and that provider. GateIron is not responsible for any third-party service, for data once it is sent to one, or for any third-party outage or change.

11. Fees

Fees, if any, are as stated when Subscriber purchases or in a written order. Unless stated otherwise, fees are payable in advance, are non-refundable and exclude taxes, which Subscriber will pay. GateIron may change fees for future periods. GateIron may suspend the Service for non-payment.

12. Suspension and Termination

GateIron may suspend or terminate access by any User or Subscriber, or any part of the Service, at any time, for any reason or no reason, with or without notice. Subscriber may stop using the Service at any time. Fees already paid are not refunded unless GateIron decides otherwise or law requires it. Every provision that by its nature should survive termination survives, including Sections 8, 9 and 13 through 19.

13. Intellectual Property

GateIron and its licensors own the Service, including its software, design, text and graphics, and the NotUserError and GateIron names and marks. Subject to these Terms, GateIron grants Subscriber and its Users a limited, revocable, non-exclusive, non-transferable right to use the Service for Subscriber's internal purposes while Subscriber is permitted to use it. All other rights are reserved. If you give GateIron feedback or suggestions, GateIron may use them without restriction or compensation.

14. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY OR QUIET ENJOYMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. GATEIRON DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, THAT NOTIFICATIONS WILL BE DELIVERED, THAT DATA WILL NOT BE LOST, OR THAT THE SERVICE WILL MEET ANY REQUIREMENT OF SUBSCRIBER, INCLUDING ANY LEGAL OR REGULATORY REQUIREMENT.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW: (A) GATEIRON WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, SAVINGS, GOODWILL, DATA OR USE, OR THE COST OF SUBSTITUTE SERVICES, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THEIR POSSIBILITY; AND (B) GATEIRON'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE FEES SUBSCRIBER PAID GATEIRON FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS. THESE LIMITS APPLY EVEN IF A LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

16. Indemnification

Subscriber will defend, indemnify and hold harmless GateIron and its members, managers, employees and agents from and against all claims, demands, losses, liabilities, damages, fines, penalties, costs and expenses, including reasonable attorneys' fees, arising out of or relating to: (a) Subscriber Data; (b) use of the Service by Subscriber, its Users or anyone admitted by Subscriber's settings; (c) any breach of these Terms, or violation of law or of anyone's rights, by Subscriber or its Users; or (d) any integration Subscriber enables. Each User likewise indemnifies GateIron for claims arising from that User's own conduct. GateIron may take part in its defense with counsel of its choosing. Subscriber may not settle any claim in a way that imposes any obligation on GateIron without GateIron's written consent.

17. Disputes

These Terms and any dispute relating to the Service are governed by the laws of the State of Oregon, without regard to its conflict-of-laws rules. The state courts located in Hood River County, Oregon, and the United States District Court for the District of Oregon have exclusive jurisdiction over any such dispute, and each party consents to their jurisdiction. To the extent law permits, any claim must be brought within one year after it arises or it is permanently barred.

18. Changes to These Terms

GateIron may change these Terms at any time by posting a revised version, effective when posted unless the revision says otherwise. GateIron may, but need not, give other notice. Continuing to use the Service after a change means accepting it.

19. General

These Terms, together with any agreement described in Section 2, are the entire agreement on their subject and supersede any prior understanding. If any provision is held unenforceable, it is enforced to the fullest extent permitted and the rest remains in effect. A failure to enforce a provision is not a waiver of it. Subscriber may not assign these Terms without GateIron's written consent; GateIron may assign them freely, including in a merger, acquisition or sale of assets. GateIron is not liable for any delay or failure caused by events beyond its reasonable control, including failures of third-party services, networks or utilities, attacks, natural disasters, epidemics, labor disputes and government action. The parties are independent contractors, and there are no third-party beneficiaries. GateIron may give notice through the Service, by email to an address associated with Subscriber's account, or by posting it. If Subscriber is a public body, Subscriber is responsible for meeting any procurement, public-records or similar obligation that applies to it, and by accepting these Terms represents that it may lawfully agree to them. "Including" means "including without limitation." Headings are for convenience only.
